Terms & Conditions

Effective March 1, 2026:

Welcome to Lionyx Lacquer (“we,” “us,” “our’).  These Terms & Conditions (“Terms”) govern your access to and use of our website [www.lionyxlacquer.com] (the “Site”) and the purchase or use of any products offered through it (collectively, the “Products”).  

By accessing the Site, creating an account, or purchasing any products, you agree to be bound by these Terms. If you do not agree, do not access or use the Site or Services.

Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to make a purchase. If you are under the age of majority, you may use the Site only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Accounts & Security

If you create an account, you agree to provide accurate, current, and complete information and to keep such information updated.

You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activity occurring under your account

Notify us immediately of any unauthorized access. Lionyx is not responsible or liable for any loss or damage arising from your failure to safeguard account credentials.

Orders, Payments & Pricing

• All orders constitute an offer to purchase, subject to Lionyx’s acceptance.
• We reserve the right to refuse, cancel, or limit orders for any reason, including inventory availability, suspected fraud, misuse, or pricing errors.
• Prices are listed in U.S. Dollars and may change at any time without notice.
• Payment must be received at the time of purchase. We accept approved payment methods listed on the Site.
• International customers are solely responsible for customs duties, import taxes, fees, and compliance with local laws.

Shipping & Delivery

• Orders are processed and shipped Monday through Friday, excluding holidays.
• Title and risk of loss transfer to you upon delivery to the carrier, not upon receipt.
• Shipping timelines are estimates only and are not guaranteed.
• Inspect shipments promptly. Missing or damaged items must be reported within 15 days of delivery. Failure to do so may result in denial of a claim.

Lionyx is not responsible for delays caused by carriers, weather, customs, or circumstances beyond our control.

Returns & Refunds

If you are unsatisfied with your order, you may request a return within 30 days of delivery. To be eligible for a return, the product must be unused, unopened, and in its original packaging. Please email hello@lionyxlacquer.com to request a return. 

• Customers may be responsible for return shipping costs, unless otherwise stated. Original shipping fees are non-refundable.
• Limited-edition, promotional, or final-sale items are non-refundable.
• We reserve the right to refuse returns that appear excessive, abusive, or fraudulent.

Product Quality, Handmade Nature & Color Variation

Lionyx Lacquer products are handmade in small to medium batches to ensure quality and uniqueness. Variations in color, finish, shimmer intensity, viscosity, texture, or appearance may occur due to formulation, lighting, application method, or screen display differences.

By purchasing our products, you acknowledge and agree that:

• Minor variations are inherent to artisanal production
• Product images are representative only and not guaranteed to match exactly
• Such variations do not constitute defects

Product Use, Breakage & Safety Disclaimer

Our products are intended for external cosmetic use only.  Handle all bottles, caps, and brushes with care.

By purchasing or using Lionyx products, you acknowledge and assume all risks associated with their use, including but not limited to:

• Glass bottles and components may break if dropped or mishandled.
• Spills, breakage, or improper handling may result in injury or property damage. 
• Individual sensitivities or allergic reactions may occur.

You agree that:

• Lionyx is not responsible for injuries, allergic reactions, cuts, burns, or damages arising from use, misuse, breakage, or storage.
• Products should be kept away from heat, flame, children, and pets.
• Broken glass should never be handled with bare hands.
• Use should be discontinued immediately if irritation occurs, and medical advice sought.

Intellectual Property

All content on the Site — including trademarks, product names, text, graphics, images, videos, and designs — is owned by Lionyx Lacquers  or its licensors and protected by intellectual property laws.

No content may be copied, reproduced, modified, distributed, or commercially exploited without prior written consent.

User Content & Social Media

Engaging with Lionyx online, including social media engagement, such as but not limited to, publishing comments, submitting reviews, tagging Lionyx Lacquers, or using branded hashtags, you grant Lionyx a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, distribute, and display such content for marketing, advertising, and promotional purposes in any media.

You represent that:

1. You own or have permission to share the content
2. The content does not infringe third-party rights

Disclaimers & Limitation of Liability

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the fullest extent permitted by law:

• Lionyx disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
• Lionyx shall not be liable for indirect, incidental, consequential, or punitive damages, including personal injury, allergic reactions, or property damage.
• Your sole remedy for dissatisfaction is discontinuation of use.

Nothing in these Terms excludes liability for gross negligence or willful misconduct where prohibited by law.

Indemnification

You agree to defend, indemnify, and hold harmless Lionyx, its owners, officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising out of your use of the Site, violation of these Terms, or misuse of our products.

Termination

We may suspend or terminate access to the Site or Services at any time, without notice. Provisions relating to intellectual property, disclaimers, indemnification, arbitration, and governing law shall survive termination.

Changes to Terms

We may update or modify these Terms at any time.  Updates will be posted on this page with a revised “Effective Date.”  Continued use of the Site after changes constitutes acceptance of the new Terms.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.  Disputes will be resolved through binding arbitration in Jersey City, New Jersey, on an individual basis.  You waive the right to participate in any class-action lawsuit or class-wide arbitration.

Severability

If any provision is deemed invalid, the remaining Terms remain in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy and any additional posted policies, represent the entire agreement between you and Lionyx Lacquer regarding your use of our Site and products.
